New York State has harsh DWI penalties

Having a prior DWI conviction on your record will increase penalties, should you be convicted for DWI again.

What happens if you are charged with multiple DWIs?

  • A first-time DWI offense will result in the suspension of your driver’s license for six months.
  • A conviction for a second DWI offense will result in a one-year suspension. In addition, you will have to complete an alcohol assessment/rehabilitation program and incur additional penalties and costs.
  • If your second DWI conviction occurred within five years of your first DWI, you will have to have an Ignition Interlock Device installed on your car and serve five days in jail or provide 30 days of community service. Additionally, if your second offense is a Felony DWI, you could be sentenced to up to four years in prison.
  • Penalties for third and fourth DWI convictions increase in severity.

In recent years, there has been a tendency in New York and other states to increase drunk driving penalties. If you are ever convicted of drunk driving again, even in another state, you could face even greater penalties. This is all the more reason why you should try to avoid a conviction now, if that is possible.
